These following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or “merchant”) and an affiliate (“you” or “affiliate”) who refers customers to use product or service from the merchant.
By participating in the Program, Affiliate agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as an Affiliate or participate in the Program in any manner.
1. Approve or Reject of the Registration
We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.
2. Affiliate Links and Coupon
Affiliate link is automatically generated, but you can also generate an affiliate link for a specific product or collection. If a person clicks on someone else’s referral link and then later they click on yours, yours is the one that counts.
Affiliate might or might not be assigned to one coupon code with details and usage clarified on Dashboard. If customer both click on the affiliate link and use coupon code, you will not receive a double commission. If you’re not assigned a branded coupon, then you’re not allowed to promote the coupon.
Commission will only be paid to the final affiliate link or code that is used before making a purchase.
Affiliates may not use discount or coupon websites in order to promote their affiliate link or coupon code. Any affiliate conversions that may be linked to discount or coupon websites will be removed and commission will not be paid.
We reserve the sole right to promote our product using pay-per-click (PPC) and paid ads to promote SmarterHome products. Any commission made from an affiliate using PPC or paid ads will not be paid.
You shall NOT engage in cookie stuffing or include pop-ups, false or misleading links on your website. Doing so will forfeit your past and current commissions.
Affiliate may also advertise merchant website on online channels such as Facebook, Instagram, TikTok or their own personal website/blog so long as it aligns with the requirements above.
3. Social Advertising Rules & Guidelines
If you are enrolled in our Program and participate in social advertising, you must adhere to our social advertising rules and guidelines as follows: (i)You ARE allowed to use your affiliate links on your own Facebook, Twitter, etc. pages.
(ii) You shall NOT post your affiliate links on Traeger’s Facebook, Instagram, YouTube, Twitter, Pinterest, etc. company pages in an attempt to turn those links into affiliate sales.
(iii) You shall NOT run Facebook ads with MySmarterHome’s trademarked company name or related terms.
(iv) You shall NOT target fans or followers of any of our social profiles (including, but not limited to, those identified below) including any variation or misspellings thereof for social campaigns including, but not limited to, Facebook, Instagram, YouTube, Twitter, LinkedIn, Pinterest or on any social network.
If you violate any of the above, you will forfeit your past and current commissions.
4. Commissions and payment
Refer any customer to make a purchase on our website, you will get a commission amount which is calculated based on Commission structure. Commission amount is dependent on order value and not including extra fee (tax, shipping cost,...).
For an Affiliate to receive a commission, you need to specify the payment details on Settings. Payment schedule will be notified on Affiliate Guide page.
All sales will remain in a “sales pending period” and will not lock until 45 days following the date of transaction. All commissions owed to you after the lock-dates will be paid to your partner account. Use of the Affiliate Program is subject to a fair use policy which gives merchant the right to review each and every referral order. Status of commission if displayed in Commission tab, any paid commission will be listed on Payment tab. Transactions that result in charge backs or refunds will not be paid out.
5. COUPON RULES & GUIDELINES
If you are enrolled in our Program and your website promotes coupon codes, you must adhere to our coupon rules and guidelines as follows:
(i)You may ONLY advertise coupon codes that are provided to you through the Program or that are displayed on our website.
(ii) You shall NOT post any information about how to work around the requirements of a coupon/promotion (i.e., first time customers only).
(iii) You shall ONLY display coupons in their entirety with the full offer, valid expiration date and code.
(iv) You shall NOT use any technology that covers up the coupon code and generates the affiliate click by revealing the code(s).
(v) You shall NOT advertise coupon codes obtained from our non-affiliate advertising, customer e-mails, paid search, social media, or any other campaign.
(vi) You shall NOT give the appearance that any ongoing offer requires clicking from your website in order to redeem.
If you violate any of the above, you will forfeit your past and current commissions.
6. REVERSAL & COMMUNICATION POLICY
In order to maintain our very low reversal rate, we reserve the right to reverse orders due to order cancellations, duplicate tracking, returns, disputed charges, and Program violations as outlined in these terms and conditions.
Additionally, if we ask you for clarification or more information on any orders or clicks that we suspect may be in violation of our terms and conditions, you shall respond in a timely and honest manner.
Below are violations of our communications policy.
(i) You are not forthcoming, intentionally vague or are found to be lying.
(ii) You are not responsive within a reasonable time period or after multiple attempts to contact you using information in your profile.
(iii) You cannot substantiate or validate the source of your traffic to our Program with clear and demonstrable proof.
(iv) You are a member of our affiliate Program with both IP tracking and Cookie tracking and receive a commission for the same transaction in both networks.
If any of the above violations occur, we reserve the right to reverse orders, set your commission to 0% or suspend you from the Program. We know that many violations are a result of automated processes; however, it is incumbent upon you to ensure that you have the appropriate checks and balances in place to proactively control your processes and adhere to our Program rules.
7. Marketing tool
We may share promotion media such as banner, logo or specific collection promotion to you through Marketing tool tab. You can download the media or get the HTML embed code in order to create and share content on your chosen affiliate channels.
8. Network
If Network tab is activated, affiliate can invite others to become their downline affiliate. If any downline affiliate brings order to merchant shop, upline affiliate will also get network commission which depends on merchant settings.
To invite other affiliates into the system, share network link and any other affiliate who click on that link and sign up will become a downline affiliate.
9. Cookie
We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them.
If a person doesn't allow cookies or clears their cookies then we can't track them so can't pay earnings on that person's activity.
Cookies day is said on the Affiliate registration form. The tracking day will start from the time a customer clicks on the affiliate’s link or use the coupon. Within the cookie time, every order made by this customer at merchant website will automatically result in commissions to the affiliate (There’s no need for the customer to click on the affiliate link then).
10. Removal from Referral Program
Any party may terminate our partnership agreement at any time for any reason.
